Workers’ Compensation New Law Signed by the Governor of NJ
On August 22, 2024, the Governor of New Jersey signed S-2822 into law. This new law increases the cap on Workers’ Compensation attorney’s fees from the current limit of 20% to 25%, subject to judicial discretion as always.
Workers’ Compensation attorneys are, in most cases, paid out of the client’s award at the time of settlement or after a judgment is rendered by Workers’ Compensation Judge. Depending on nature of the settlement/judgment, the share that the client typically pays out of their award is anywhere from 8% up to, now, 25%. The Workers’ Compensation judge must always approve any attorney’s fee finding it to be fair and reasonable.
